  4. This is a very good point. I remember the case. Do you think the Texas Supreme Court would hold Amazon liable, or do you think it would punt it to the legislature?
  5. Correct. That is the crux. However, there is a huge distinction. Amazon never takes title to the product. It is not a reseller. It is a logistics company. As far as I know (but I could be shown to the contrary), product liability has never been imposed upon any person who is not in the chain of title of the product. Is this a distinction without a difference? That's the argument that's being made. It's certainly a novel argument. IMO, being in the chain of title is a very important aspect of liability. Otherwise, small tech players will be at a disadvantage to big tech. As the article points out, Amazon is willing to be held to liability as long as the same rule applies to everyone else who hopes to compete with Amazon (and the other big players). There is a concern that if this becomes the new standard, it will stifle competition and cement Amazon's monopoly even more. It's very interesting!

  8. I watch the football games, but not play-by-play. I have seen nor heard barely anything about "politics" in them. The same can't be said for NBA games, unfortunately, and the distraction turned me off from them.
  9. If there's not enough value there to justify getting a local lawyer to act as your agent, the better approach might be to just hire a trash removal service and let them have at it. Otherwise, I would think a local attorney would be a good route. They have bar licenses and a fiduciary duty. Plus, they know what's legal and what's not.

    It's kind of ironic for the government to be pressuring Facebook to filter other people's speech. But yeah... I get it. I saw the documentary. What happens when the government controls social media?

    Hey, Zen. Come out and play! I have no issue with the way Google handled that meme. The funny thing is it supports my earlier claim that we have enough homegrown fake news. In other words, focusing on Russians is a red herring.

  16. "reasonable," "rational," "timely," "adequate," "prompt," "diligent..." - they're all vague. That's life. We can't get by without vagaries; yet, somebody has to decide whether there is compliance.
  17. It's an assertion of power so long as there is a reasonable basis. Interestingly, when it comes to legislation, the Supreme Court's test is "rational basis," meaning even if reasonable minds would agree it's bad policy, as long as it is rational, it will stand. Contrast this with the quote as it pertains to orders issued by governing officials. Is this a requirement that the order be "reasonable?"

  20. Guild by association surely isn't fair, but my parents raised me to know that I need to be careful not to associate with people who could get me in trouble. I've protested before, too, but if the crowd is there burning stuff and fighting, you can count me out. I'll just stay home.

  22. The problem is the violence is right there... juxtaposed to the peaceful people. If you want to be peaceful, that's no place to be.

  24. Violence isn't emanating out of churches. I'd hate to be a cop right now. In fact, I wouldn't risk it. I'd quit and find another career.
