I took a look at the source code for one of MCA's posts - and it's a hotlink to an image file on some porno website. I don't think he could be 'prosecuted' for that, but he certainly could (and should) be perma-banned, unless it's a virus of some sort. Hopefully, he can be banned by IP rather than screen name.

And as I mentioned in another post - I think this person and 'HondaRacing' are likely one in the same.

I saw both "MiniCooperAddict" and "HondaRacing" post last week in a thread in General Questions about the Indy 500. It seemed benign, albeit off topic, but no big deal, really - that is, until today.

While I suppose it is possible that someone else got on this person's computer, I would still send Detective Briscoe to bust some chops here, such as: "If it ain't you, pal, then who the hell is it, the Pillsbury Dough Boy? You better start singin' my tune, or we're taking a little trip downtown."

DEFINITELY a prosecutable offense....at least, it should be.

OK, Amy....it makes more sense now. I was going through my "mental list" of posters, and forgot about him. It makes me wonder how many other screennames this user has......

I sincerely hope this fella gets his legal due - lest anyone try it again. Maybe then, future hellraisers will think twice.

Does anyone know any legal precedent for such actions? Can this be prosecuted?

"Detective Briscoe" is from "Law And Order". He has a way of getting information out of people. Like walking up to a jobsite where a subject to be interrogated is working, and saying New Yawk style "how about you quit the tap-dancing, and start answering questions, or I'll give my buddy down at the building inspector's office a call, and check and see how safe things really are down here"2.gif

I wouldn't mind this poster finding out what Rikers is like.

Although that could potentially be restrictive (in other words, contrary to Klipsch's, and our aims to keep this as inclusive as possible), but having a bit of an application/approval process might be the way to go, where basic verifiable info would be given to Klipsch to participate, as many other forums currently do. Then again, if an example is made out of this particular offender, that could be used as a future example that it's not a good idea doing that kind of stuff around here.

As for prosecutable:

Title 21, Section 1021, Oklahoma Statutes

A. Every person who willfully and knowingly . . .

3. Writes, composes, stereotypes, prints, photographs, designs, copies, draws, engraves, paints, molds, cuts, or otherwise prepares, publishes, sells, distributes, keeps for sale, knowingly downloads on a computer, or exhibits any obscene material or child pornography . . .

shall be guilty, upon conviction, of a felony and shall be punished by the imposition of a fine of not less than Five Hundred Dollars ($500.00) nor more than Twenty Thousand Dollars ($20,000.00) or by imprisonment for not less than thirty (30) days nor more than ten (10) years, or by both such fine and imprisonment.

The I.P. address is definitely something that the webmaster can get ahold of. I would imagine there is a way to block the I.P. address and simply ban the computer from logging on again. However, as the saying goes, "where there's a will, there's a way." This will only make it more difficult for him to log on. If he truly wants to get in, he will. I'm not sure of the best solution to this problem, but a strongly worded letter from the Klipsch attorney may be helpful, especially if young johnny rottencore is a minor. In that situation, I'm sure his parents would take care of the problem.11.gif

Very few people have static IP addresses. In order to keep him off, you'd have to block the entire range of IP adresses the ISP owns. So, say for example it was AOL or MSN, that probably wouldn't be a good thing.
